PRIVACY POLICY FOR ENS ELEARNING SOLUTIONS

ENS eLearning Solutions Inc. specializes in the design, development, delivery, and support of e-Learning products and services. To provide these services we must collect and use some limited client information. This information is used solely for the purposes identified within our privacy policy and is never disclosed to a third party.

To protect client personal information to a high standard, we have adopted the CSA Model Code for the Protection of Personal Information as the basis for our privacy policy. This code is a National Standard of Canada and is incorporated into Canada's new private sector privacy law, the Personal Information Protection and Electronic Documents Act. How our privacy policy complies with this code is described below.

Accountability

ENS eLearning Solutions Inc. is accountable for all subscriber personal information under its control.

From time to time personal information may be accessible by or transferred to a supplier for processing on our behalf. For example, this includes suppliers who may be contracted to provide support services for this web site. We require all of our suppliers to protect subscriber personal information as per our privacy policy.

Responsibility for compliance with this privacy policy rests with ENS eLearning Solutions Inc. (see individual access and challenging compliance, below). Purposes for which we collect and use Personal Information

We collect and use personal information in order to promote our products and services, to respond to inquiries and to provide end-user and product support. We will not use this information for any other purpose. When individuals contact us, we will obtain informed consent before any personal information is used.

Consent

We only collect your personal information with your knowledge and consent.

If you decide to purchase our services, we will consider this as implied consent to use your personal information for the purposes identified above.

We consider that consent to use your e-mail address to contact you is implied when you correspond with us by e-mail. We will not, however, use your e-mail address for any subsequent purpose without your consent.

From time to time, we may use list suppliers to obtain names and addresses of individuals that we believe would have an interest in our products and services. Should you receive information from us and wish to know how we obtained your name and address, please contact us. We only deal with list suppliers who are members of the Canadian Marketing Association and who adhere to the CMA Code of Ethics and Standards of Practice.

Please note that under Canada's new Personal Information Protection and Electronic Documents Act, the name, business address and business telephone number of an employee of any organization are not considered to be personal information subject to this Act. We will, however, be pleased to remove your business contact information from our lists upon request.

Limiting Collection

We will only collect the personal information required for the purposes described above. All personal information is collected by fair and lawful means.

The personal information we collect and use is typically the name, business title, business address, business telephone number, fax number and the business e-mail address. We do not collect or use e-mail addresses, unless they are provided directly by individuals who have clearly asked to be contacted by e-mail.

Web site information collected from site visitors

In addition to personally identifiable information, we collect non-identifiable traffic data from visitors about the usage of our web site. Following is a brief description of the information that we collect and how it is used.

Your Internet Protocol (IP) Address: every computer using the Internet is automatically assigned an Internet Protocol (IP) address. This address identifies the computer and permits communications with a web site or e-mail server. We collect the IP addresses of site visitors for system administration, and to generate aggregated statistics on site visitors such as how long visitors remain on the site, and which pages visitors access and download. This information helps us to optimize and improve the content of our site.

We do not use any methods to link IP addresses to any personally identifiable information, except if required to protect our site from unauthorized access or misuse.

Your browser and operating system: we collect information about the type of Internet browser software you are using and your operating system in order to provide information in a format that is best suited to your computer's system.

Referring domain name or URL: we also collect the domain name of the site or URL (Unique Resource Locator) page from which you linked to our site and the name of the domain or URL to which you exit. This information helps us understand how visitors locate our site and which links, if any, they use when exiting (see Links to other web sites).

Links to other web sites: we provide links to a large number of other web sites to provide convenient access to other related information. The inclusion of any site does not represent an endorsement of the site. We are not responsible for the privacy practices of other web sites or how your personal information may be used when you leave our site.

Additional web site information collected from subscribers

Cookies: Cookies are small text files that are "set" on a user's hard drive by a web site operator in order to record certain site preferences or other information. We use cookie files only in the areas of our site that are accessible solely to our e-Learning Portal clients. Your browser can be configured to reject cookies or warn you in advance before one is set.

Passwords: to access the client side of our site, users must supply a password. For security reasons and to protect your password, your password cannot be stored as a cookie file. You must enter your client password each time you log on.

Our e-Learning Portal maintains a copy of the client password in an offline file. Clients can request of the system to email their password back to them based on the personal profile information provided to us. This password is used solely for the purpose of online access and can be changed by the client at any time.

Limiting Use, Disclosure and Retention

We will only use your personal information for the purposes for which it was collected. We will not disclose your personal information to any other party, except if required by law.

We will only retain your personal information as long as we continue to have a business relationship with you and to provide you with a reasonable opportunity, after the termination of any business relationship, to re-utilize to our services and take advantage of any discounts or offers that may exist for re-subscribing customers.

We maintain payment files for a period of five years, at which time the files are destroyed in a secure manner.

Accuracy of Information

We will make every reasonable attempt to ensure your personal information is accurate for its intended purposes.

Typically, the personal information of our e-Learning Portal clients is provided directly by the client. When we collect personal information directly from you, we will verify that we have recorded it accurately.

If you believe that any personal information is inaccurate, please contact us.

Safeguards

All personal information collected by us is protected by appropriate security safeguards, including the use of physical security (i.e. locked filing cabinets) and computer security measures.

Employees and contractors of ENS eLearning Solutions Inc. are aware of the importance of maintaining the confidentiality of subscriber information.

Your Right of Access

Upon request, we will inform you as to whether or not we hold any personal information about you, provide a detailed record of any personal information we may hold about you and how it is used, and indicate the source of the information. You have the right to challenge the accuracy and completeness of any personal information and have it amended as appropriate. We will respond to all access requests within a maximum of 30 days.
